Shippping, Refund and Returns Policy

We use USPS services, as displayed at checkout.

No returns on ammunition, launchers, or other products unless defective.

You have 30 days to return an item for defects.

We test every launcher with 3 full magazines before shipping.

Returns are handled by mail and shipping fees are the responsibility of the purchaser. Please insure your return shipment. If an item is found to be defective your shipping cost will be reimbursed.

The buyer is responsible for all import fees. Sorry but we only take returns from the United States and Canada.

No change of address after payment.

Grimburg products can be lethal.

Do not use them unless you are within your legal right to do so.
They are not to be used in any paintball games.
Do not test fire at people or animals.

Ricochet Hazard

This is a solid projectile that is designed not to deform or absorb energy on impact and thus presents an extreme ricochet hazard. Please choose an appropriate target and backstop to avoid ricochet. And always be aware what is beyond and around your target.

It is the responsibility of the purchaser to make sure Grimburg products are legal where they are being shipped to.

You attest you are at least 18 years of age or older and will conform to all laws governing the use and ownership of airguns in your local area.

Use of these rounds other than what they were designed for is a crime.

Use at your own risk.

Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless Grimburg Less Lethal LC, and our respective past, present and future employees, officers, directors, contractors, consultants, equity holders, suppliers, vendors, service providers, parent companies, subsidiaries, affiliates, agents, representatives, predecessors, successors and assigns (individually and collectively, the “Grimburg Less Lethal LC parties”), from and against all actual or alleged Grimburg Less Lethal LC party or third party claims, damages, awards, judgments, losses, liabilities, obligations, penalties, interest, fees, expenses and costs of every kind and nature whatsoever, whether known or unknown, foreseen or unforeseen, matured or unmatured, or suspected or unsuspected, in law or equity, whether in tort, contract or otherwise (collectively, “claims”), including, but not limited to, damages to property or personal injury, that are caused by, arise out of or are related to (a) any use or misuse of the sites, content or products by you or any third party you authorize to access or use such sites, content or products, (b) any user content you create, post, share or store on or through the sites or our pages or feeds on third party social media platforms, (c) any feedback you provide, (d) your violation of these terms, and (e) your violation of the rights of another. you agree to promptly notify Grimburg Less Lethal LC of any third party claims, cooperate with the Grimburg Less Lethal LC parties in defending such claims and pay all fees, costs and expenses associated with defending such claims (including, but not limited to, attorneys’ fees and expenses, court costs, costs of settlement and costs of pursuing indemnification and insurance). you further agree that the Grimburg Less Lethal LC parties shall have control of the defense or settlement of any third party claims. this indemnity is in addition to, and not in lieu of, any other indemnities set forth in a written agreement between you and Grimburg Less Lethal LC.

Limitations of liability and damages

To the fullest extent permitted by applicable law, in no event shall the Grimburg Less Lethal LC parties be liable for any indirect, special, incidental, or consequential damages of any kind (including, but not limited to, loss of revenue, income or profits, loss of use or data, loss or diminution in value of assets or securities, or damages for business interruption) arising out of or in any way related to the access to or use of the sites or content (including, but not limited to, user content, third party content and links to third party sites), or the order, receipt or use of any product, or otherwise related to these terms (including, but not limited to, any damages caused by or resulting from reliance on any information obtained from Grimburg Less Lethal LC parties, or from events beyond the Grimburg Less Lethal LC parties’ reasonable control, such as site interruptions, deletions of files or emails, errors or omissions, defects, bugs, viruses, trojan horses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of god, communications failure, theft, destruction or unauthorized access to the Grimburg Less Lethal LC parties’ records, programs or systems), regardless of the form of action, whether based in contract, tort (including, but not limited to, simple negligence, whether active, passive or imputed) or any other legal or equitable theory (even if the party has been advised of the possibility of such damages and regardless of whether such damages were foreseeable).

To the fullest extent permitted by applicable law, in no event shall the maximum aggregate liability of the Grimburg Less Lethal LC parties (jointly) arising out of or in any way related to (a) the order, receipt or use of products purchased from the Grimburg Less Lethal LC store exceed the amount paid for such products.. the foregoing limitations shall apply even in the event your remedies hereunder fail of their essential purpose, and the foregoing shall constitute the Grimburg Less Lethal LC parties’ sole liability and obligation in respect hereof, regardless of the form of action, whether based in contract, tort (including, but not limited to, simple negligence, whether active, passive or imputed), or any other legal or equitable theory.

To the fullest extent permitted by applicable law, you release Grimburg Less Lethal LC and the other Grimburg Less Lethal LC parties from responsibility, liability, claims, demands, and/or damages (actual and consequential) of every kind and nature, known and unknown (including, but not limited to, claims of negligence), arising out of or related to disputes between users and the acts or omissions of third parties. you expressly waive any rights you may have under California civil code § 1542 as well as any other statute or common law principles that would otherwise limit the coverage of this release to include only those claims which you may know or suspect to exist in your favor at the time of agreeing to this release.

GOVERNING LAW; VENUE
These Terms and our relationship with you will be governed by the laws of the State of Maine, excluding its choice of laws rules. You and Grimburg Less Lethal LC each irrevocably agrees that any Dispute between the parties that is not subject to arbitration or cannot be heard in small claims court, shall be resolved on an individual basis exclusively in the U.S. District Court for Maine or the state courts located in Maine. You and Grimburg Less Lethal LC each irrevocably consents to the personal jurisdiction of these courts and waives any and all objections to the exercise of jurisdiction by these courts and to this venue. Notwithstanding the foregoing, however, you and Grimburg Less Lethal LC agree that Grimburg Less Lethal LC may commence and maintain an action or proceeding seeking injunctive or other equitable relief in any court of competent jurisdiction. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect.
